Prenuptial and Postnuptial Agreements

A prenuptial agreement is essentially a contract between two competent and consenting adults entered prior to their marriage to each other. The document typically addresses the separate property of each party, their intentions concerning marital property as acquired during their marriage and the disposition of all those things in the event of divorce, dissolution, or death. The agreement also may include provisions relative to spousal and/or child support.

In the past, a prenuptial agreement could not be changed or modified. However, on March 23, 2023, Senate Bill 210 was passed, allowing, through a postnuptial agreement, couples to modify and/or terminate most prenuptial agreements.

Prenuptial and postnuptial agreements are complex and legally distinct documents. Attorney Terilla has extensive experience in advising parties relative to the required disclosures necessary for preparing the various terms and conditions parties seek in a prenuptial or postnuptial agreement, together with explaining the significance and consequence of such provisions.
